These Regulations set out the general terms, conditions and method providing by JFL Polska with its registered office in Poznań electronic sales services for Users' Accounts by electronic means, through the Operator hereinafter referred to as: "www.jofel.com.pl".



§ 1 Definitions



  • Password - means a string of letters, numbers or other selected by the User when setting up an account at www.jofel.com.pl, used to secure access to the user's account at www.jofel.com.pl

  • User Account - means an individual panel for each User, launched on his behalf by the www Operator .jofel.com.pl, after creating an account by the User (User registration at www.jofel.com.pl) in the scope of placing orders at www.jofel.com.pl under an individual e-mail address (change of e-mail address will require the creation of a new account).

  • Employer - means a User who, based on a separate agreement with JFL Polska. has the ability to place orders at www.jofel.com.pl.

  • Login - means the individual designation of the User, determined by him, consisting of a string of letters , digital or other, required with the password to log in to the User's account at www.jofel.com.pl. The login is the User's valid email address.

  • Regulations - means these regulations www.jofel.com.pl.

  • Account creation - means the actual act performed in the manner specified in the regulations, required for use by Users with all functionalities www.jofel.com.p

  • Website www. jofel.com.pl - means websites under which the Operator runs the Internet Sales Platform (Store) operating in the domain www.jofel.com.pl

  • Operator - means in of the owner www.jofel.com.pl, which is

  • User - means a natural person, legal entity or non-legal entity whose law is grants legal capacity to conduct business activities on its own behalf.

  • Workdays - all days of the week from Monday to Friday, excluding public holidays

  • Order processing time - the time when the Store will complete the order and forward it to the carrier performing the form of delivery chosen by the Customer

  • Client - having a Customer account in the Store: an adult natural person with full or limited legal capacity, a legal person or an organizational unit without legal personality making purchases in the Store

  • Customer Basket - list of Products to be ordered by the Customer

  • Products - range of products available to order at www.jofel.com.pl

  • Consumer - a person within the meaning of art. 221 of the Civil Code,

  • Consultant - a customer service person, communicating with the consumer by phone, via the contact form or in writing

  • Customer Account - a database containing customer data for min. for the execution of orders, order history, customer preferences regarding selected store functionalities, payment details

  • Traditional transfer - payment made by the Customer at the bank via an online or fixed account or at the post office

  • Electronic transfer - payment made by the Customer from an online bank account via online payment systems

  • Personal Collection Point - a point run by JFL Polska, where you can collect an order processed by a store

  • Digital Content - content within the meaning of Article 2 point 5 of the Act on Consumer Rights of May 30, 2014 (Journal of Laws item 827)

  • Electronic files - digital content in the form of a file to be read on an appropriate electronic device; PDF - a recording format that can be read after downloading to any electronic device equipped with a PDF reader, DRM (Digital rights management) - digital rights management. Security system to prevent the illegal use of data against the right holder

  • Civil Code - The Act of April 23, 1964 (Journal of Laws of 2014, item 121, as amended); Consumer Rights Act - Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827)

  • Electronic Services Act - Act on the provision of electronic services of July 18, 2002 (Journal of Laws of 2013, item 1422, as amended).



§ 2 General provisions



  1. All rights to www.jofel.com.pl, in including proprietary copyrights, intellectual property rights to his name, internet domain, website www.jofel.com.pl, as well as to patterns, forms, logos belong to the operator or are made available by the supplier of the products, and their use can only take place in a defined manner and in accordance with the Regulations.

  2. jofel.com.pl is provided by the Operator via the network internet and websites www.jofel.com.pl as a resource of the ICT and IT system.

  3. The operator reserves the right to place on www.jofel.com .pl advertising content regarding goods and services of third parties, in forms used on the Internet.


§ 3 Using www.jofel.com.pl



  1. Using www.jofel.com.pl means the User's action, which leads him to read the content on www.jofel.com.pl, subject to the provisions of §4 of the Regulations.

  2. Using www.jofel.com.pl can take place only on the terms and to the extent specified in the Regulations.

  3. The operator will endeavor to use www.jofel.com .pl was possible for Internet Users using popular web browsers, operating systems, device types and internet connection types. The minimum technical requirements enabling the use of the Website www.jofel.com.pl are Internet Explorer, Chrome and FireFox in the latest available version, with Javascript enabled, accepting cookies and internet connection with a bandwidth of at least 256 kbit / s. www.jofel.com.pl is optimized for a minimum screen resolution of 1024x768 pixels.

  4. To set up a User Account at www.jofel.com. com, it is necessary for the User to have an active e-mail account.

  5. Users using www.jofel.com.pl do not is entitled to any interference in the content, structure, form, graphics, mechanism of action www.jofel.com.pl.

  6. It is forbidden for the User to provide illegal content and use by Www.jofel.com.pl User or free services provided by the Operator, in a manner contrary to the law, decency, violating personal rights of third parties or legitimate interests (operator www.jofel.com.pl).

  7. The Operator declares that the public nature of the Internet and the use of services provided electronically may involve the risk of obtaining and modifying Users' data by unauthorized persons, which is why Users should use appropriate technical measures that will minimize the above-mentioned threats. In particular, use anti-virus programs and protect the identity of those using the Internet. The Operator never asks the User to provide the Password in any form.




§ 4 Account creation



  1. In order to create a User Account, the User is required to set up an account.

  2. To create an account, the User should complete the Account Creation form shared by the Operator at www.jofel.com.pl and send the completed form electronically to the Operator by selecting the appropriate function found in the Account creation form. When setting up the account, the User sets an individual Password.

  3. Creating an account follows the rules below:

    1. The user should complete all form fields, unless the field is marked as optional;

    2. The information entered in the form should only apply to the User and comply with true, however, the User is the person responsible for the accuracy of the information entered in the form;

    3. The User should read the Regulations available when creating the account;

    4. User By creating an account, he wishes to conclude a contract for the provision of electronic services, for his benefit by the Operator, services of maintaining a User Account, whereby the User does not express his will to conclude a contract prevents the creation of a User Account;

    5. User By creating an account he consents to the processing of his personal data contained in form to provide services on the basis of contracts concluded in accordance with the Regulations, with the User having the right to access their data and correct and delete it.

  4. After submitting the completed form, the User receives immediately, electronically to e-mail address provided in the confirmation form. Account creation by the Operator asking for confirmation and activation of the User Account.

  5. Activation occurs by selecting redirection to www.jofel.com. en, which is included in the sent e-mail. At this time, an agreement is concluded for the electronic provision of the User Account service, and the User gains access to the User Account and free services provided under the User Account.

  6. The user is obliged to make every effort to maintain confidentiality and not disclose third parties Password. In the event of circumstances indicating a suspicion that the Password has been in the possession of an unauthorized person, the User is obliged to immediately notify the Operator of this fact, using the available means of communication.

  7. The operator creates and implements security against unauthorized use, reproduction or distribution content contained on www.jofel.com.pl. If the Operator applies the above safeguards, Users undertake to refrain from any actions aimed at removing or bypassing such safeguards or solutions.



§ 5 Services



  1. The operator provides 24 (twenty four) hours a day, 7 (seven) days a week for Users who have set up an electronic account free of charge Service of User Account, under which the User has the option of:

    1. ordering,

    2. choose the payment method,

    3. carrier selection,

    4. making changes to your account, correcting or deleting data

  2. The User Account Maintenance service is available after the account is created, on the terms described in §4 of the Regulations.

  3. The User who has set up an account may request the Service Provider to delete the Account User. The request to delete a User Account is tantamount to termination of the contract for the provision of the User Account service in accordance with §9.

  4. The Operator is entitled to block access to the User Account and services, if the User acts to the detriment of the Service Provider or other Users, the User violates the law or the Regulations, as well as when blocking access to the User's Account and free services is justified by security reasons - in particular: breaking the security by the User www.jofel.com. com or other hacker activities. Blocking access to the User Account and free services for these reasons lasts for the period necessary to resolve the issue being the basis for blocking access to the User Account and free services. The Operator notifies the User about the intention to block access to the User Account and services by electronic means to the address provided by the User in the Account creation form.

  5. The operator reserves the right to choose and change the type, form, time and the method of granting access to selected goods, about which he will inform Users in a manner appropriate to amend the Regulations.

  6. The operator reserves the right to carry out promotional campaigns, sales and introducing them changes in accordance with the regulations in force in this respect. The above permission does not affect the prices of goods in orders placed before the date of entry into force of the change, terms of promotional campaigns or sales.

  7. Promotions in the Store cannot be combined, unless the regulations of the promotion state otherwise . Delivery costs will be included in the prices of goods in proportion to their weight. The delivery of goods takes place in the manner chosen by the Customer and specified in the order.

  8. The store reserves the right to carry out promotional campaigns, sales and introducing them changes in accordance with the regulations in force in this respect. The above permission does not affect the prices of goods in orders placed before the date of entry into force of the change, the conditions of promotional campaigns or sales. Promotions in the Store are not subject to combining, unless the regulations of the promotion provide otherwise. IV. Delivery costs will be included in the prices of goods in proportion to their weight. The delivery of goods takes place in the manner chosen by the Customer and specified in the order.

  9. Beginning of the order:

    The customer can choose the following payment methods for ordered goods with delivery on Polish territory:

    a ) payment on delivery, order processing begins after the ordering process is completed, except there are goods that are specified in the store as "On order" then to complete such an order a full prepayment for the ordered goods is required and it is not refundable in the event of cancellation of the order.

    b ) bank transfer, order processing begins after the Store receives confirmation of the bank transfer - after receiving the payment to the Store's bank account,

    For selected goods, the Operator reserves the right to disable certain forms payment for the order, about which the Customer will be informed by phone or via email.



§ 6 Complaints



  1. The User may submit a complaint to the Service Provider regarding the use of services provided by electronic means by the Operator.

  2. Complaints should be submitted in electronic form and sent to the electronic address Service providers provided in the Contact tab or via the contact form available at www.jofel.com.pl.

  3. In the complaint, the User should include his Login and description of the problem .

  4. Due to the complexity of the system and stored logs, complaints regarding specific system errors should be submitted immediately, but no later than 3 (three) business days from the situation.

  5. Operator immediately, but not later than within 14 (fourteen ) days he considers the complaint and responds to the User's e-mail address provided in the complaint.



§ 7 Responsibility



  1. The operator is not responsible for failure to perform or improper performance of services provided by the road electronic, if it is caused by third parties (in particular telecommunications operators, e-mail operators, telecommunications link providers and electricity).

  2. The operator provides a system with the ability to place orders, but is not responsible for the content.

  3. However, the operator is liable as for his own actions or inaction for actions. or omission of persons with the help of which he performs services provided electronically, as well as persons to whom he entrusts the performance of these services.

  4. The operator is not responsible for the impossibility or difficulty of using the www .jofel.com.pl, resulting from reasons attributable to the User, in particular for the loss of the User by the User or the possession by third parties (regardless of the method) of his Password.

  5. However, the operator responds if the User loses or acquires possession by third parties his Password was due to reasons attributable to the Operator or reasons for which the Operator is responsible.

  6. The Operator is not liable for damages caused by Users' actions or omissions. , in particular for their use of www.jofel.com.pl in a manner inconsistent with applicable law, Regulations or available Instructions.

  7. The sole source of the Service Provider's obligations is these Regulations and applicable law .

  8. The user bears full responsibility for the purchase offers submitted and failure to recognize with the terms and regulations and failure to comply with the obligations to the Employer may lead to the removal of the User's account or marking him as an unreliable Customer.




§ 8 Personal data and "Cookies"



  1. The administrator of Users' personal data provided to the Service Provider voluntarily under Account creation, is the Operator.

  2. Personal data will be processed by the Operator only on the basis of processing authorization data and solely for the purpose of performing services provided electronically by the Operator and other purposes specified in the Regulations.

  3. Personal data provided to the Service Provider is provided to him voluntarily, however provided that failure to provide the data required when creating an account prevents the creation of a User Account.

  4. In this case, the User may submit offers without creating a Contractor's account (submitting offers without creating an account).

  5. Anyone who provides their personal data to the Service Provider has the right to access to their content and to correct them.

  6. The User is obliged not to disclose to third parties information about other Users, which he received from the Service Provider in connection with the use of www.jofel.com.pl, unless he obtained prior consent from the User to whom the data relate.

  7. Information received from the Service Provider may only be used by the User for purposes related to implementation of contracts concluded between Users.

  8. The operator provides the option of removing personal data from the kept file, in particular in the event of deleting the User Account.

  9. The operator may refuse to delete personal data if the User has violated applicable law rights, and the preservation of personal data is necessary to clarify these circumstances and determine the User's liability.

  10. The operator protects the personal data provided to it and makes every effort to secure them against unauthorized access or use.

  11. The collection of Users' collected personal data is treated as a separate database , stored on the Operator's server, in a special security zone, ensuring adequate protection.

  12. The operator does not transfer, sell or lend the collected personal data Users to other persons or institutions, unless this happens with the explicit consent or at the request of the User, in accordance with applicable law or at the request of the court, prosecutor's office, police or other authorized body in the event of Users violating the law.

  13. The Operator reserves the right to disclose to companies and services cooperating with the Operator online aggregate general statistical summaries of Users. These rankings relate to viewership www.jofel.com.pl and do not contain Users' personal data.

  14. The operator uses the mechanism of "cookies", which when used by Users from the www.jofel.com.pl Website are saved by the Service Provider's server on the hard disk of the User's end device.

  15. The use of "cookies" is aimed at the proper functioning of the Website .jofel.com.pl on Users' end devices. This mechanism does not damage the User's end device and does not change the configuration of Users' end devices or software installed on these devices. "Cookies" are not intended to identify Users.

  16. The operator uses the "cookies" mechanism to:

    1. remembering information about Users' end devices;

    2. verify and develop your offer;

    3. presenting ads tailored to your preferences

    4. determining the location of the User

    5. collecting statistical data

  17. Any User can disable the "cookies" mechanism in their web browser terminal equipment. The operator indicates that disabling "cookies" may, however, cause difficulties or prevent the use of the website www.jofel.com.pl.



§ 9 Termination of the contract



  1. According to the Act of 30 May 2014 on consumer rights , The Customer who is a Consumer may withdraw from the contract in writing without giving a reason within 14 days of collecting the parcel. In order to make a statement on withdrawal from the contract, the Consumer may use the withdrawal form and should submit a statement on withdrawal from the contract by sending the above-mentioned statement to the address: JFL Polska, ul. Katowicka 33/31, 61-131 Poznań.

  2. Returned goods must be complete. Goods should be returned unchanged, unless a change was necessary within the ordinary management, i.e. the consumer should handle the goods bearing in mind the need for its possible, subsequent return. The consumer is responsible for reducing the value of things as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of things.

  3. Consumer right to withdraw from the contract is not applicable in the case of: / span>

    1. when the subject of the service is a perishable or short-lived item fitness for use;

    2. when the subject of the service is an item delivered in a sealed package, which after the opening of the packaging cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery;

    3. when the subject of the service are things that after delivery, due to by their nature, they are inseparably connected with other things.

  4. The store refunds the goods returned with delivery costs within 14 (fourteen) days according to the rules described in Section VIII Repayment to customers. The consumer bears the direct cost of returning the item to the Store.


§ 10 Final provisions and amendment of the Regulations




  1. The regulations apply from the date of publication on the Website www.jofel.com .pl and replaces the previous regulations www.jofel.com.pl

  2. The content of these Regulations can be recorded by printing, saving to media or download at any time from www.jofel.com.pl

  3. Regulations may change. Each User will be informed about the content of changes to the Regulations by posting by the Operator on the main page www.jofel.com.pl a message about the changes to the Regulations, containing a list of changes to the Regulations and maintaining this information on the main page www.jofel.com.pl for at least 14 (fourteen) consecutive calendar days, and Users with a User Account will be additionally notified by the Operator by sending to the e-mail address indicated by them in the account creation form, information containing a list of amendments to the Regulations.

  4. Notification of changes to the Regulations, in the manner specified above, will occur no later than 14 (fourteen) calendar days before the introduction of the amended Regulations. If the User who has a User Account does not accept the new content of the Regulations, he is obliged to notify the Operator about this fact within 14 (fourteen) days from the date of notification of the change in the Regulations. Lack of acceptance results in termination of the contract in accordance with the provisions of §9.

  5. In the event of a dispute under the Sales Agreement, the parties will they sought to resolve the matter amicably. The law applicable to any dispute arising under these Regulations is Polish law.
